1. Acceptance of Terms

By accessing or using BrandMind ("Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms apply to all visitors, registered users, and any other persons who access or use the Platform. We reserve the right to update these Terms at any time, with notice provided to you as described in Section 14.

2. Description of Service

BrandMind AI is an AI-powered brand content and social media management platform that enables you to:

• Generate AI-assisted marketing content, captions, and campaign materials
• Schedule and publish content to connected social media accounts
• Manage your brand kit including logos, color palettes, fonts, and tone of voice
• View analytics and performance insights from connected social platforms
• Collaborate with team members on content creation and approvals

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.

3. Eligibility & Account Registration

• You must be at least 18 years old to create an account and use the Platform
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized access to your account
• One person or entity may not maintain more than one free account

4. Acceptable Use Policy

You agree to use the Platform only for lawful purposes. You must not:

• Publish, schedule, or distribute content that is unlawful, defamatory, harassing, obscene, or fraudulent
• Infringe the intellectual property rights of any third party
• Use the Platform to send spam, unsolicited messages, or automated bulk content
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Platform
• Use the Platform to violate the terms of any connected social media platform
• Resell, sublicense, or commercially exploit the Platform without our written consent
• Upload viruses, malware, or any other malicious code

Violation of this policy may result in immediate suspension or termination of your account.

5. Connected Social Media Accounts

When you connect a social media account to BrandMind AI, you grant us permission to act on your behalf. By connecting any platform you confirm:

You may disconnect any social account at any time from your account settings. We are not responsible for content published via third-party platform errors or API outages.

6. AI-Generated Content

• AI-generated content is provided as a starting point and may require review and editing before publication
• You are solely responsible for reviewing, approving, and publishing any AI-generated content
• We do not guarantee the accuracy, originality, or fitness of AI-generated content for any particular purpose
• You must not use AI-generated content to mislead, deceive, or misrepresent facts to your audience
• Ownership of AI-generated content you publish through the Platform belongs to you, subject to our license below

7. Intellectual Property

7.1 Our Platform

The Platform, including its design, code, features, logos, and trademarks, is owned by BrandMind AI and protected by intellectual property laws. You may not copy, reproduce, or create derivative works without our prior written consent.

7.2 Your Content

You retain ownership of all content, brand assets, and data you upload to the Platform. By uploading content you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely to provide the Platform's services.

7.3 Feedback

Any feedback, suggestions, or ideas you provide about the Platform may be used by us freely without obligation, compensation, or attribution to you.

8. Subscription & Billing

• Free accounts are subject to usage limits as described on our pricing page
• Paid subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except where required by applicable law
• We reserve the right to change pricing with 30 days' prior notice
• Failure to pay may result in suspension or downgrade of your account
• Taxes applicable to your jurisdiction are your responsibility unless collected by us

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Uninterrupted, error-free, or secure operation of the Platform
• Accuracy or reliability of any content generated or displayed
• Results from use of connected third-party social media platforms

11. Limitation of Liability

To the maximum extent permitted by law, BrandMind AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising from your use of or inability to use the Platform.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the three (3) months preceding the claim.

12. Termination

• You may delete your account at any time from your account settings
• We may suspend or terminate your account immediately for a material breach of these Terms
• We may suspend or terminate your account with 30 days' notice for any other reason
• Upon termination, your right to use the Platform ceases immediately
• Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law survive termination

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will notify you via email or a prominent notice on the Platform at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes your acceptance of the revised Terms.
